Privacy policy of www.ferrowings.no

  1. This privacy policy governs the processing of personal data collected via the website www.ferrowings.no (hereinafter: „FerroWings”).
  2. This FerroWings privacy statement is for information purposes only, i.e. it does not create any obligations for FerroWings service recipients or customers.
  3. The owner of FerroWings and at the same time the data manager of Ferro Wings Sp.z o.o. Sp.K with its registered office in Zielona Góra, ul.Przylep – 8 Maja 41, 66-015 Zielona Góra, NIP 9291901007, REGON 365914817, registered in the National Court Register by the District Court in Zielona Góra, 8th Commercial Division of the National Court Register under KRS number 0000648608.
  4. Personal data collected through the shop name via FerroWings is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), also known as RODO.

  5. The owner of FerroWings shall pay particular attention to protecting the interests of the data subjects and shall in particular ensure that the data it collects are processed lawfully; that they are collected for specified legitimate purposes and are not subject to further processing incompatible with those purposes; that they are accurate and adequate to the purposes for which they are processed; and that they are kept in a form which permits identification of data subjects for no longer than is necessary for the purposes of the processing.

§ 1 Purpose and nature of the data processed and legal basis

  1. The purpose, scope and recipients of the data processed by the administrator result in each case from the customer’s activity at FerroWings. For example, if a customer expresses a wish to be contacted when submitting a contact form, his or her personal data will be processed in order to contact the customer.
  2. The personal data of the customers are collected in the case:
    1. Subscription to the newsletter for the purpose of fulfilling the contract, the subject of which is a service provided electronically. The customer data are recorded by Benhauer Sp. z o.o. in the SalesManago system. Legal basis – consent of the data subject to the performance of the agreement on the provision of newsletter services (Article 6(1)(a) RODO).
    2. Use of the FerroWings contact form to fulfil the contract electronically. Legal basis: Necessary for the performance of the contract for the provision of the „contact form” service (Article 6(1)(b) RODO).
  3. The Administrator may process the following personal data of customers using FerroWings:
    1. E-Mail Adress
    2. Name
    3. Telephone
    4. The administrator can additionally process the company name and the tax identification number (NIP) of the client
  4. When using the FerroWings website, additional information may be collected, in particular: the IP address assigned to the customer’s computer or the external IP address of the Internet provider, the domain name, the browser type, the access time, the operating system type.Navigation data may also be collected from customers, including information about links and references they click on or other actions they perform in the online shop. Legal basis – Legitimate interest (Article 6(1)(f) RODO), which is to facilitate the use of services provided electronically and to improve the functionality of those services.
  5. The transmission of personal data to www.ferrowings.no is voluntary.

§ 2 Who is the data shared with or entrusted to and how long is it kept?

  1. The customer’s personal data is transferred to the service providers used by www.ferrowings.no for the operation of the website. The service providers to whom the personal data is transferred are, depending on the contractual agreements and circumstances, either subject to the instructions of www.ferrowings.no regarding the purposes and means of data processing (commissioned processors) or determine the purposes and means of data processing themselves (data controllers).
    1. www.ferrowings.no uses suppliers who process personal data only on the instructions of the FerroWings owner. These include, but are not limited to, hosting service providers, accounting services, marketing system providers, FerroWings traffic analysis systems and marketing campaign effectiveness analysis systems.
    2. Administrator. www.ferrowings.no works with service providers who do not act solely on instruction and who themselves decide on the purpose and use of customers’ personal data. They offer electronic payment and banking services.
    3. Location. The service providers are mainly based in Poland and other European Economic Area (EEA) countries.
  2. The personal data of the customers are stored:
    1. If the basis for processing personal data is consent, the customer’s personal data will be processed by FerroWings as long as consent is not revoked and, after revocation of consent, for a period corresponding to the limitation period of claims which the customer may assert and which may be brought against him. The limitation period is six years, unless a special legal provision provides otherwise, and three years for claims for recurring services and claims in connection with the exercise of an economic activity.
    2. If the basis for the data processing is the performance of a contract, the personal data of the customer shall be processed by www.ferrowings.de for as long as it is necessary for the performance of the contract and thereafter for a period corresponding to the limitation period of claims. The limitation period shall be six years, unless a special provision provides otherwise, and for claims for continuous performance and for claims in connection with the conduct of business – three years.
  1. Navigation data may be used to provide a better service to customers, to analyse statistical data and to adapt the website to customers’ preferences, as well as to administer FerroWings.
  2. If the customer subscribes to the newsletter, FerroWings will send emails with commercial information about promotions and new products from FerroWings.
  3. The newsletter contract is concluded when the activation link sent by the FerroWings owner to the e-mail address provided by the user in the form on the FerroWings website is activated.
  4. Cancellation is effected by sending an e-mail with the subject „Cancellation” to the e-mail address newsletter@ferrowings.pl or by clicking on the link contained in the footer of each newsletter.
  5. In the event of a request, it shall make the personal data available to the competent state authorities, in particular the organisational units of the Public Prosecutor’s Office, the Police, the President of the Office for Personal Data Protection, the President of the Office for Competition and Consumer Protection or the President of the Office for Electronic Communications.

§ 3 Cookie mechanism, IP address

  1. Cookies are small pieces of information in the form of text files that are sent by a server and stored on the page of the visitor to the FerroWings website (e.g. on the hard drive of your computer, laptop or the memory card of your smartphone – depending on which device the visitor to the FerroWings website is using).   2. The Administrator may process the data contained in the cookies when using the FerroWings website for the following purposes:
    a) Storage of data from completed forms and surveys;
    d) to adapt the content of the FerroWings website to the individual preferences of the customer (e.g. with regard to colours, font size, page layout) and to optimise the use of the FerroWings website;
    e) for the creation of anonymous statistics on the use of the online shop’s website by Google Analytics (external cookie administrator: Google Inc. based in the USA);
    f) Studying the characteristics of visitors’ behaviour by analysing their actions (repeated visits to websites, keywords, etc.) in order to create a profile and send them advertising tailored to their expected interests, even if they visit other websites (remarketing);
    g)  Popularisation of FerroWings via the social network Facebook.com. (Managers of external cookies: Facebook Inc. based in the USA or Facebook Ireland based in Ireland).
  3. The cookie mechanism is safe for the computers of FerroWings customers. In particular, it is not possible for viruses or other unwanted software or malware to enter customers’ computers via this route. However, customers have the option in their browsers to restrict or disable the access of cookies to computers. When this option is used, the use of FerroWings is possible, except for functions that by their nature require cookies.

§ 4 Rights of the data subjects

You have the following rights:

  1. The right to be informed about the processing of your data to the extent set out in Article 15 RODO.
  2. the right to rectify inaccurate or incomplete personal data concerning you in accordance with Article 16 of the RODO.
  3. The right to erasure („right to be forgotten”) of your personal data stored by us, where further processing is not necessary, in accordance with Article 17 of the GDPR:
    – for the exercise of the right to freedom of expression and information;
    – to comply with a legal obligation;
    – for reasons of public interest;
    – for the establishment, assertion or defence of claims.
  4. The right to restrict the processing of your personal data in accordance with Article 18 of the GDPR, provided that:
    – the accuracy of your personal data is contested by you;
    – the processing is unlawful and you object to its erasure;
    – we no longer need your personal data, but you need it to establish, assert or defend your claims;
    – you have objected to the processing in accordance with Article 21.
  5. the right to receive the data you have provided to us in a structured, commonly used and machine-readable format and to transfer it to another controller in accordance with Article 20 of the GDPR („right to data portability”).
  6. the right to complain to a supervisory authority in accordance with Article 77 of the RODO. As a rule, you can contact the supervisory authority of your usual place of residence, your place of work or our registered office in this matter. If you have any questions regarding the collection, processing and use of your personal data, the correction, blocking or deletion of your data as well as the revocation of consent given or the objection to the use of your data for the purposes stated in this data protection declaration, please contact the controller: (e-mail address / telephone number, if applicable). Right to object. If we process personal data in the ways described in this privacy statement in order to protect our legitimate interests, you may object – with effect for the future – to the processing of your data for these purposes. If we process your data for direct marketing purposes, you may exercise your right to object at any time. If processing is carried out for other purposes, you only have the right to object on grounds relating to your particular situation. After you have exercised your right to object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests and rights, or the processing is for the assertion, exercise or defence of legal claims. This does not apply if the processing is for direct marketing purposes. In this case, we will no longer process your personal data for the above-mentioned purpose.

§ 5 Changes to the privacy policy

  1. The privacy policy is subject to change and will be communicated to users 7 days in advance.
